OpenAI may have made a fatal misstep in copyright fight with news orgs

Thursday, July 9, 2026

OpenAI faces potential sanctions after the company did not preserve ChatGPT system logs that The New York Times requested in a copyright infringement lawsuit, according to court filings. The Times sued OpenAI in December 2023, alleging the company used millions of copyrighted articles to train its AI models without permission. OpenAI did not retain the logs despite a legal obligation to preserve evidence once litigation was reasonably anticipated, according to The Times' filing.
