ICE likely violated First Amendment by issuing warning to critic, judge rules

Wednesday, September 16, 2026

A federal judge ruled that U.S. Immigration and Customs Enforcement likely violated the First Amendment when agents visited the home of a Rochester, New York resident who had sent a critical email to ICE's acting director. The resident subsequently filed suit against the Department of Homeland Security. The judge's ruling found the visit constituted retaliation for protected speech.
