Trump admin proposes ending 60-day grace period after job loss for H-1B, other visa holders
Thursday, September 10, 2026
The Department of Homeland Security and U.S. Citizenship and Immigration Services proposed eliminating the 60-day grace period that currently allows H-1B visa holders to remain in the United States after losing employment. Under the proposal, foreign workers on H-1B visas would be required to depart immediately upon job termination rather than having 60 days to secure new employment or change visa status. The proposal would apply to H-1B and other visa categories with similar grace periods. No effective date for the proposed rule was provided in available materials.
