States now must report undocumented immigrants to DHS or risk federal funding, DOJ says

Wednesday, September 2, 2026

The Department of Justice issued guidance stating that states receiving federal funding for Temporary Assistance for Needy Families and Supplemental Security Income programs must report undocumented immigrants to the Department of Homeland Security or face potential loss of that funding. The DOJ opinion applies to both assistance programs and establishes reporting as a condition of federal funding eligibility. States have discretion in implementation timing and procedures for compliance with the reporting requirement.
