Court rules Kalshi sports bets aren't "swaps," just gambling with a different name

A federal court ruled that Kalshi's sports betting products do not qualify as exempt swap contracts under federal law, determining instead that they constitute gambling subject to state regulation. The decision rejected Kalshi's argument that its offerings fell outside the Commodity Exchange Act's definition of swaps. Nevada gambling authorities can proceed with enforcement actions based on the ruling.
